Counsel for the complainant, Jagadish Shastry contended that since the Disabilities Commissioner had a position similar to any civil court, noncompliance of his direction amounted to contempt of court. While the Commissioner had directed a redo of recruitments by providing five per cent reservations to the disabled, the department had completed the recruitments without doing so, he stated. He also said that another direction to carry out one time special recruitments for the disabled had also not been complied with, till date.
The Division Bench headed by Justice SR Bannurmath observed that the Commissioner was placed similar to a civil court for the purpose of Contempt of Courts Act, and ordered notices to the officers.
