Madras High Court cancels Admission of ineligible MBA, MCA students

The Madras HC has quashed the admission of 68 MBA / MCA students in various colleges as they had not obtained the minimum eligible marks. The court also permitted the affected students to seek compensation and claim refund of fee paid to the colleges, and directed the colleges to return the amount without any deduction.

Though the AICTE has mandated 50% of marks as minimum requirement for open category candidates for admission to MBA / MCA courses, and 45% for reserved categories, these students were admitted despite not having the minimum prescribed marks.

A total of 68 students rushed to court after they were disallowed by the university to appear for their examination.

Passing the Final orders on the matter, Justice V Ramasubramanian declared their admission illegal. “The institutions are the actual wrong – doers. After admitting students contrary to regulations, these institutions hide behind the back of students and indulge in shadow litigation, as they know they cannot plead either equity or sympathy.

They make the students appeal to the conscience of this court, so that along with the students the wrongdoings of the managements of these colleges would also get white-washed,” the judge said.
