Sastra University B.Ed Equivalent to Government Degree

The Tamil Nadu government has issued an order stating that the B.Ed degree course offered by Sastra University under the Distance Education programme ( two years ) is equivalent to B.Ed degrees awarded by the government.

The G.O. of 28th July, 2011 was produced before a Division Bench consisting of Justices D.Murugesan and K.K.Sasidharan which was hearing appeals filed by the Director of Elementary Education and others, challenging a single Judge’s order.

The Bench recorded the Government and disposed of the appeals.

The Judges set aside the costs of 10,000 imposed on each of the three petitions by the single Judge.

With the issue of the G.O., a controversy around the certificates was now settled.

In February, a single Judge allowed writ petitions filed by T.Lakshmi and two others whereby it directed the official authorities to permit them to join duty forthwith and to allow them to function in appointed posts. He also said the petitioners were entitled to costs.

The appeals raised a question as to whether the Sastra University’s B.Ed degree would be considered equal to the degrees issued by the Tamil Nadu government for securing employment and further service benefits.

The teachers’ contention was that the university’s degree was valid for all purposes.

The government’s stand was that the certificates could not be considered equivalent to B.Ed degree certificates given by it for selection, appointment and consequential service benefits.

The Bench observed that teachers who were already employed and the candidates who had been selected, but appointment orders had not been issued in view of the dispute, were now entitled to the benefit of the university’s certificates not only for selection, but also for appointment and service benefits. It permitted the government to conduct counselling for promotion and transfer of teachers.

The Advocate – General made a submission that in view of the G.O., the costs may be set aside. After hearing counsel, the Bench set aside the costs.
